Terms & Conditions of Participation & Attendance
By attending, participating in, performing at, selling at, or otherwise taking part in Belmont Village Bestival (“Bestival”), you agree to the following Terms & Conditions.
1. General Participation
Bestival is a community-focused, outdoor arts and music festival. Participation includes, but is not limited to, vendors, food vendors, performers, workshop facilitators, volunteers, contractors, and attendees.
All participants agree to act respectfully toward festival staff, volunteers, artists, vendors, attendees, local residents, and the surrounding neighbourhood.
Bestival reserves the right to refuse participation or remove any individual or entity whose conduct is deemed unsafe, disruptive, or inconsistent with the values of the festival.
2. Assumption of Risk
Bestival is an outdoor event that may involve uneven ground, weather exposure, amplified sound, crowds, food preparation, and physical activity. All participants and attendees acknowledge and voluntarily assume all risks associated with attending or participating in the event, including but not limited to personal injury, illness, allergic reaction, loss, or property damage.

3. Vendors, Performers & Workshop Facilitators
Original Work & Conduct

Vendors must sell original, creator-made work unless otherwise approved by the festival.

Food vendors must sell only items approved in advance as part of their application.

Performers and facilitators must present content appropriate for a public, community-oriented, and family-friendly environment.

The sale or distribution of illegal, unsafe, or offensive materials is prohibited.
Setup & Operations

Participants are responsible for their own equipment, materials, displays, food preparation, and merchandise.

Setup and teardown must occur only during designated times.

Participants must remain within their assigned footprint and comply with all site rules.
Compliance

Vendors and facilitators are responsible for complying with all applicable laws, including tax, licensing, food safety, fire safety, and insurance requirements.

Food vendors must comply with all local public health regulations, including inspections, permits, and safe food handling practices.

Bestival may require proof of permits, inspections, and insurance prior to the event.

Participants may be subject to inspection by public health or fire authorities during the event.
4. Food Safety & Allergen Disclosure (Food Vendors)

Food vendors are solely responsible for the safe preparation, handling, storage, and service of food and beverages.

Mandatory allergen signage is required at every food vendor booth, clearly listing common allergens present in the food, in accordance with local public health requirements.

Food vendors must be prepared to answer allergen-related questions from attendees.

Bestival is not responsible for food-related illness, allergic reactions, or dietary concerns.

Bestival reserves the right to shut down any food vendor who fails to meet health or safety requirements.
5. Fire Safety & Open Flame (All Participants)

All participants must comply with local fire codes and fire department requirements.

The use of open flames, propane, gas appliances, generators, candles, heating elements, or cooking equipment must be approved in advance by Bestival and may require permits or inspection.

Fire extinguishers of an appropriate type and size must be present at any booth or activity involving heat, cooking, or electrical equipment.

Tents, canopies, and décor must be flame-resistant where required by regulation.

Bestival reserves the right to prohibit or shut down any equipment or activity deemed unsafe by festival staff or fire officials.
6. Health, Safety & Accessibility
All participants must comply with instructions from festival staff, security, emergency services, and city officials at all times.
Bestival reserves the right to modify schedules, locations, or activities for safety, weather, or operational reasons.
Harassment, discrimination, or threatening behaviour of any kind will not be tolerated.
7. Alcohol, Substances & Prohibited Items

Alcohol may only be consumed in designated, licensed areas.

Food vendors may not sell alcohol unless specifically authorized and licensed.

Illegal substances and prohibited items are not permitted on site.

Bestival reserves the right to remove any person found in violation of these rules.
8. Media, Photography & Recording
Bestival may photograph, film, or record portions of the event for promotional, archival, or educational purposes.
By attending or participating, you grant Bestival the right to use your image, likeness, voice, or performance in such materials without compensation.
9. Weather, Cancellations & Changes
Bestival is a rain-or-shine event unless otherwise stated.
The festival reserves the right to modify, postpone, relocate, or cancel programming due to weather, safety concerns, or circumstances beyond its control.
Bestival is not responsible for costs incurred by participants due to such changes.
10. Limitation of Liability
To the fullest extent permitted by law, Bestival, its organizers, partners, sponsors, staff, and volunteers shall not be liable for any loss, injury, illness, allergic reaction, damage, or expense arising from participation in or attendance at the event.
Participants and attendees agree to release and hold harmless Bestival from any related claims.
11. Acceptance of Terms
Participation in or attendance at Bestival constitutes acceptance of these Terms & Conditions.
Failure to comply may result in removal from the event without refund or compensation.

8. Merchandise Sales & Refunds
All merchandise sales made through Bestival, whether digital or physical, are final. Digital merchandise is non-refundable once purchased. Physical merchandise is non-refundable except in cases of defect or fulfillment error. Bestival is not responsible for compatibility issues, delivery delays beyond its control, or misuse of purchased merchandise. Digital merchandise is for personal, non-commercial use only unless otherwise stated.
9. Vendor & Food Truck Fees and Refunds
All vendor and food truck fees are non-refundable once payment has been submitted. Refunds will only be issued if Bestival cancels the vendor or food truck’s participation agreement, except where cancellation results from the vendor’s or food truck’s violation of Bestival’s Terms & Conditions, Code of Conduct, or applicable laws or regulations. No refunds will be issued for vendor or food truck cancellation or withdrawal, weather conditions, reduced attendance or sales, site layout or scheduling changes, or failure to comply with festival policies.
10. Media, Photography & Recording
Bestival is a public event. Photography, audio recording, and video recording may occur throughout the festival for promotional, archival, educational, reporting, and grant-related purposes. By attending or participating, you consent to the use of your image, likeness, voice, or performance in such materials without compensation.
